Data Protection Information
This document is designed to provide you with information on personal data we gather through the use of our websites (the “Sites”), and how information about you (your “personal information”) is used. This policy applies to the Sundyne, LLC family of companies (collectively, “Sundyne”). Please read this policy before using, or submitting information to, the Sites. You agree to the terms of this privacy policy by using the Sites.
What Information Do We Collect?
We may collect, store, and use the personal information you voluntarily provide to us through our Sites. For instance, we may collect your contact information if you provide it to us through the “contact us” form, the “registration” form, or through other forms available on the Sites. These forms may ask for such information as your name, the company you work for, business title, postal address, email address, telephone number and other information. You must be 18 years of age or older to submit this information to our Sites. You may also voluntarily provide your personal information to us through the “Job Search” portal on our website.
In addition, if you choose to correspond with us through email, we may retain the content of your email messages together with your email address and the resulting correspondence with you.
When you visit the Sites, some information is collected automatically. The web servers that we use store the following data by default:
- The name of your internet service provider
- The website and browser from which you visited us
- The websites which you visit when you are with us
- The amount of time you spend on our Site
- Your IP address
Automated technology we use to collect information in connection with your use of the Sites includes the following:
- Browser and Device Information: Certain information is collected by most browsers or automatically through your device, such as your device type, operating system name and version, device manufacturer and model, and Internet browser type and version. We use this information to ensure that the Sites function properly.
- Cookies: Cookies are pieces of information stored directly on the computer or mobile device that you are using. Cookies allow us to collect information such as browser type, time spent on the online services, pages visited, referring URL, and other aggregated website traffic data. Refer to the Client/Prospect Choices and Opt-Out section of this policy for information on how you may be able to reject or disable cookies.
- IP Address: Your IP address is a number that is automatically assigned to the computer that you are using by your Internet Service Provider (ISP). An IP address may be identified and logged automatically in our server log files whenever a user accesses the Sites, along with the time of the visit and the page(s) that were visited. Collecting IP addresses is standard practice and is done automatically by many websites, applications, and other services. We use IP addresses for purposes such as calculating usage levels, diagnosing server problems and administering our online services. We may also derive your approximate location from your IP address to understand from what regions of the world our Site visitors come.
How Do We Use The Information We Collect?
We may use the personal information you provided to us through our Sites or through email correspondence with us to market to you per the preferences you specified. Our marketing efforts include business-to-business direct marketing and promotional information related to our services or products.
We only collect, use, share, store, or otherwise process your personal information when we have an appropriate basis. For example, we may process your personal information as necessary to provide services that are subject to terms you have accepted, such as our Terms of Use. We may process your personal data when necessary to comply with legal obligations, or for purposes of pursuing legitimate interests (such as providing products and services, recruiting and selecting qualified candidates for employment, improving the services and the Sites, performing internal analytics, preventing fraud, enforcing legal claims, and security purposes) if doing so is consistent with your rights and appropriate to the context.
We may also use the information we collect to fulfill requests you have made to us, such as to communicate with you, respond to your inquiries and provide newsletters or updates. We may also use your information to make our Sites easier for you to use. We may use the information to inform you of service and product updates, white papers, new products, market research opportunities and other related information from us.
Who Do We Share Information With?
We may share your personal information with our third-party partners, such as channel partners, distributors, and affiliate companies who are able to address or respond to your inquiries, or with our service providers who perform services on our behalf. If Sundyne uses third-party companies for data processing in order to fulfill any obligations with regard to you, these parties are contractually obligated to handle your data carefully in compliance with the provisions of data privacy law and according to our instructions and neither to use this data for their own purposes nor to disclose it to third parties. We may provide your personal information to a third-party when required by law, for example, to comply with any court order or legal process, or to investigate or prevent unlawful activities or misuse of the Sites. We may also provide your information to a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock (including in connection with any bankruptcy or similar proceedings).
We may share your personal information with any other party with your prior consent.
Client/Prospect Choices and Opt-Out
We strive to provide you with choices regarding your personal information. We have created the following mechanisms to provide you with control over your information:
Email: We maintain contact lists to communicate with our clients and prospects. All email messages sent to these lists include an opportunity to unsubscribe or opt out of future email messages. You may also request to be removed from future email messages by contacting us via email at: marketing@sundyne.com or privacy@sundyne.com.
Cookies: If you do not want information collected through the use of cookies, you may be able to adjust your browser or device settings to automatically decline cookies or be given the choice of declining or accepting the transfer to your device of a particular cookie (or cookies) from a particular site. If, however, you do not accept cookies, you may experience some reduced functionality associated with the Sites.
Some Internet browsers have a “do-not-track” feature that lets you tell websites that you do not want to have your online activities tracked. These features are not yet uniform, and our Sites are not set up to respond to do-not-track signals. We do not permit third parties to use the Sites to collect personal information about users’ online activities over time and across different websites.
Retention of Information
Sundyne retains your information for as long as you have an open and active account with us or as needed to provide you the services or information you requested. We will retain and use your information to comply with our legal obligations, resolve disputes and enforce our agreements.
Data Security and Data Transfers
The data collected via the Sites is transferred to protected servers in the United States. Only certain individuals who are involved in technical, customer, or content support are authorized to access personal information. We have implemented technical and operational security measures that are designed to secure personal information from accidental loss and from unauthorized access, use, alteration, and disclosure.
Where we transfer personal information from the EU to our subsidiaries, affiliates, service providers, and business partners located outside of the EU in connection with the Sites’ operations, we rely on data transfer agreements with relevant parties to help establish adequate safeguards. The data transfer agreements could include the standard contractual clauses adopted by the European Commission, binding corporate rules, the EU-U.S. Privacy Shield program, or other framework deemed adequate by the European Commission.
However, please note that, due to the structure of the Internet it is possible that the rules of data privacy and the aforementioned security measures may not be observed by other individuals or institutions over which we have no responsibility. In particular, information that is provided without encryption, even if this is done by email, can potentially be read by third parties. We do not have any technical influence on this. It is the users’ own responsibility to protect the data that they are providing from misuse by using encryption or another method.

If you are located in the EEA or Switzerland, then you may have additional rights to request access to, correction of, erasure of, or the transfer of your personal information, as well as the right to object to or restrict the processing of your personal information. We may revise this privacy policy from time to time. Any other changes to this privacy policy will be posted here and other places we deem appropriate so that you are aware of what changes have been made in how we collect, use and disclose your information.
